Idaho Foreclosure Process ~ In Idaho the primary method of foreclosure is a deed of trust foreclosure. The deed of trust issued at the time of purchase must contain a power of sale clause in order to facilitate a non-judicial foreclosure (the most common method of foreclosure in Idaho). Properties over 40 acres must go through a judicial foreclosure. Depending on the timing of various required notices, it usually takes approximately 150 days to effectuate an uncontested non-judicial foreclosure.
